Agreement


By accessing and using OntimeGov website, you are agreeing to these terms and conditions of use. You should read them carefully and if you do not agree to these terms and conditions, you should not use the website, or any site linked to it.

Your agreement to terms and conditions set forth herein constitute a legal agreement between you (“you”, or “your”) and ONTIME Government Services L.L.C (“ONTIME GOV”, or “we”, or “our” or “us”).

Eligibility for Membership

ONTIME GOV wishes to ensure that its members are able to form legally binding contracts and further that minors do not purchase unsuitable content. Therefore, membership of OntimeGov’s website is not available to persons under the age of twenty-one (21) lunar years. You represent that you are twenty-one (21) lunar years of age or over the twenty-one (21) lunar years before you become a member of the OntimeGov’s website. Without prejudice to any other rights and remedies of ONTIME GOV under this Agreement or at law, ONTIME GOV reserves the right to limit or withdraw access to OntimeGov’s website or the membership of any person if ONTIME GOV believes that person is under the age of twenty-one (21) lunar years. OntimeGov’s website is not available to persons whose membership has been suspended or withdrawn by ONTIME GOV. Further, if you are registering as a business entity, you represent that you have the authority and capacity to bind that entity to this Agreement and that you and the business entity will comply with all applicable laws relating to the subject matter.

Modification of Terms and Conditions


Access to OntimeGov’s website is provided by ONTIME Government Services L.L.C (ONTIME GOV). By accessing and using the website, you agree that ONTIME GOV may update or modify these terms and conditions and other terms, policies or information of or on the website at any time without advance notice.​

Modified terms and conditions and other terms, policies or information will take effect once posted on the website, unless otherwise stated. You should re-read these terms and conditions every time you visit the website to ensure that you are aware of all current terms and conditions. Accordingly, your continued access and use of the website after any modification is deemed to be acceptance of the modified terms and conditions.

Acceptable Use

By accessing the website, you agree that you will not:
  • deface, alter or interfere with the front end or content of the website or any linked sites or the underlying software code;
  • take any action, which imposes an unreasonable or disproportionately large load on the website or related infrastructure;
  • do anything, which will or might damage, interfere with, disrupt access to, interrupt or impair the functionality of the material available on or through OntimeGov’s website, nor to upload any material that contains any computer viruses or other codes, files or programs designed to interrupt, destroy or limit the functionality of any software or equipment;
  • post, distribute or otherwise upload any defamatory, libelous, offensive, infringing, obscene, indecent, harmful, threatening, abusive, tortuous, racially or ethnically objectionable or otherwise unlawful material or information or send any chain letters, junk mail, 'spamming' material or any other form of bulk communication, advertising or solicitation;
  • upload, post, email or otherwise transmit any materials that you do not have a right to transmit under any law or under a contractual relationship;
  • provide false or misleading information about yourself, your business or create a false identity, or provide information that is not factual in nature.
  • provide any Information or content which (in our sole discretion) may not be considered to be in compliance with general Islamic Sharia law, rules, morals, values, ethics and traditions.
  • provide any information or content which may (in our sole discretion) threaten national security;
  • provide any information or content which may (in our sole discretion) constitute or be considered to promote gambling.
  • use OntimeGov’s website to commit a criminal offence or to encourage others to engage in any conduct which would constitute a criminal offence or give rise to civil liability;
  • obtain or attempt to obtain unauthorized access to OntimeGov’s website or any private or member account areas on the website, nor to impersonate any person or misrepresent your affiliation with another person;
  • post any material that infringes upon or violates the intellectual property rights of another, do, cause or permit anything to be done that may infringe, damage or interfere with any intellectual property rights of ONTIME GOV or third parties. Also, not to do anything that is otherwise unlawful or which may create any liability on the part of ONTIME GOV or collect or store personal information about others.
  • If ONTIME GOV considers that you have breached any of these terms and conditions or have otherwise demonstrated inappropriate conduct when using the website, ONTIME GOV reserves the right to:
  • warn you that you have breached these terms and conditions, and ask you to stop such conduct;
  • delete any material or content, which you may have posted without notice to you;
  • take measures (including terminating, suspending or restricting your access) to, and preventing you from using OntimeGov’s website;
  • report your activities to an internet service provider or relevant authorities; and/or
  • take legal action against you.
  • Our Website will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE


Intellectual Property


All intellectual property rights in OntimeGov’s website throughout the world belong to ONTIME GOV and the rights to use them are licensed to you (not sold). You have no intellectual property rights in (including, but not limited to, any information, data, material, text, designs, graphics, pictures, video, photographs, applications, software, audio and other files) other than the right to use them solely for your own personal use, in accordance with the terms of this Agreement. Republication or redistribution of the content, including by framing or similar means, is prohibited.

Registration


Certain areas of the OntimeGov’s website are limited to registered users and or allow a user to request support or services online by entering personal information. You agree that any information you provide in these areas will be complete and accurate. Furthermore, you agree that you will not register under the name of, nor attempt to enter the OntimeGov’s website under the name of, another person, and that you will not adopt a username that is offensive, in ONTIME GOV’s sole discretion.

Use of Credit Card


We accept payments online using Visa and MasterCard credit/debit card in AED (or any other agreed currency. Your credit card will be debited when you click on the confirm button. We will make every effort to maintain confidentiality when securing an online payment. This covers the security of your credit card details and other personal information. All of your personal information is encrypted as it travels over the Internet.

OntimeGov’s website may contain links and pointers to internet sites maintained by third parties. ONTIME GOV operates or controls, in any respect, any information, products or services on such third-party sites. Third-party links and pointers are included solely for your convenience, and do not constitute any endorsement by ONTIME GOV. You assume sole responsibility for use of third-party links and pointers.

Indemnity


You agree to defend, indemnify and hold ONTIME GOV indemnified from and against any claims, actions, damages, losses, liabilities, costs (including legal fees on a full indemnity basis), expenses or payments whatsoever, which ONTIME GOV suffers, incurs, or is liable for, whether or not contemplated by the parties, arising out of claims resulting from your use of OntimeGov’s website including without limitation any claims alleging facts that, if true, would constitute a breach by you of these terms and conditions. You agree to cooperate fully in the defense of any such claim. ONTIME GOV reserves the right to assume, at its own expense, the exclusive defense and control of any matter otherwise subject to indemnification by you. You must not settle any matter without the prior written consent of ONTIME GOV.

Disclaimer of Warranty

You expressly understand and agree that your use of OntimeGov’s website and applications and any material available through this website is at your own risk. ONTIME GOV will not warrant that OntimeGov’s website will be uninterrupted, problem-free, free of omissions, or error-free; nor it makes any warranty as to the results that may be obtained from the use of OntimeGov’s website. The content and function of OntimeGov’s website are provided to you, to the extent permitted by law, without warranties of any kind, either expressed or implied.

Limitation of Liability

ONTIME GOV expressly excludes all conditions, warranties and guarantees, whether express or implied, statutory or otherwise. ONTIME GOV will not be liable for any damages or injury caused by, including, but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus or line failure. ONTIME GOV will not be liable for any damages or injury, including, but not limited to, incidental, indirect, special, punitive, exemplary or consequential damages that result from the use of, or the inability to use, the materials on or through this website, even if there is negligence, or ONTIME GOV or an authorized ONTIME GOV representative has been advised, knew or should have known of the possibility of such damages (including for loss of profits, use, data or other economic advantage).​The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages. In such cases, the total liability of ONTIME GOV to you for all losses, damages and causes of action (in contract, tort [including without limitation, negligence], or otherwise) will not be greater than the amount you paid to access this website.

Choice of Law and Jurisdiction

Your use of OntimeGov’s website is and these terms and conditions are subject to the laws of the United Arab Emirates and you agree to submit to exclusive jurisdiction of the courts in the Emirate of Dubai (excluding DIFC), United Arab Emirates.

REFUND POLICY

This policy (“Refund Policy” or “Policy”) applies only to Services fees (as defined below) available on https://ontimegov.com/ that is solely owned by Ontime Government Services L.L.C (“ONTIME GOV”, or “we”, or “our” or “us”). This Policy does not apply to Government fees that their refund is subject to the discretion of the respective Government (as defined below) and its refund policies, if any.

It is important that You read this Refund Policy carefully. You should familiarise yourself with the terms of this Refund Policy, prior to purchasing any services from ONTIME GOV. By using the services offered by ONTIME GOV, You have read, understood, and agreed to ONTIME GOV’s Refund Policy.

DEFINITIONS

  • Application means an application form duly completed and submitted through E-GOV website by You for the provision of Services that are listed on E-GOV Website.
  • Government means the relevant government authority.
  • Issuer means the bank or entity who has issued Your credit or debit card.
  • Refund Eligibility Criteria means the criteria stated herein.
  • Refund Request Form means the ONTIME GOV’s form with requested information and supporting documents to request a refund which may be completed and submitted online.
  • Service Fees means the fees payable by You for the Services purchased in accordance with the Services Terms and Conditions.
  • Services means all services that are available on https://ontimegov.com/ and provided by Ontime Gov.
  • Transaction Charges means any fees levied by a bank or financial institution or entity for processing a valid Refund Request to the Applicant.
  • E-Gov means Ontime Government Services L.L.C. or any of its subsidiaries, associate or affiliate or group companies.
  • Website means the https://ontimegov.com/ website.
  • Website Terms and Conditions means the terms and conditions applicable to and posted on https://ontimegov.com/terms.

GENERAL REFUND CONDITIONS

  • The applicants are responsible to visit the E-Gov Website to access the Refund Policy.
  • The Service Fee may be refundable subject to the terms herein and provided that the Applicant has paid for the Services. The Applicant may request a Refund only in accordance with the Refund Eligibility Criteria.
  • The Refund Policy shall be governed by the applicable local laws in the Emirate of Dubai, UAE.
  • Refunds of Service Fees will only be considered where the Applicant complies with the Refund Eligibility Criteria. If the Applicant fails to meet any of the Refund Eligibility Criteria, E-Gov shall have the right in its sole discretion to decline the request for a Refund.
  • To apply for a refund, the Applicant must properly and fully complete and submit a Refund Request Form together with all supporting documents online. Click here for the form.
  • E-Gov may process the Applicant’s Refund Request as soon as reasonably practicable. Response times may vary depending on the mode of payment and reasons for a refund request for the Service Fees. E-Gov may notify the Applicant of the outcome of the request in accordance with the timelines set out in the Refund Processing Timelines.
  • By completing and submitting the Refund Request Form, the payment of a refund of the Service Fees is not guaranteed. The refund may be approved or rejected by E-Gov in its discretion.
  • Any Transaction Charges or loss due to exchange rate fluctuation or bank charges or administrative fees which may be levied for processing a refund of Service Fees shall be borne solely by the Applicant and shall be deducted by E-Gov from the amount to be refunded.
  • GST / VAT / similar such indirect taxes, if any, charged on the Service Fees may be refunded, subject to applicable tax laws.

REFUND ELIGIBILITY CRITERIA

  • All requests for Refunds shall only be accepted and considered if a Refund Request Form is submitted online by an Applicant within 30 days from the date of the Application date.
  • If the Applicant has been charged more than once for the same services or the Applicant has paid a sum in excess and the Applicant can provide proof of such excess charge, the Applicant may be entitled to claim a refund on the terms herein.
  • Requests for refunds or cancellation of a Service shall not be accepted and no refunds shall be given where:
    • the Applicant has partially used the Service.
    • the Applicant decides not to proceed with their application.

REFUND PROCESSING TIMELINE

A Refund of Service Fees may be processed within thirty (30) working days from the date of notifying the Applicant of the refund decision.

RECEIVING YOUR REFUND

Refunds will be processed using the same mode of payment made for the Services. For example, if payment was made with a credit or debit card, the refund will also be made to the same credit or debit card.

If E-Gov is unable to process a refund by the same mode by which payment was made, then E-Gov shall notify the Applicant of the alternate mode of payment for processing such Refund.

In case of payments made by debit or credit card, the date by which Refund amount shall be credited to the Applicant’s card shall depend on the card issuer.
